Terms and Conditions of Employment

  • The employer shall assume cost of transportation to worksite and to point of hire upon completion of contract

  • The employer shall provide the workers with free food and lodging

  • The employer shall provide his workers with first-aid facilities and shall bear the expenses of treatment, medicines and transportation of employee to the hospital, if his case so requires

  • The workers’ probationary period should not be more than 1 month

  • Guaranteed wages are higher than the minimum $200.00 salary

  • For private companies, 100% of salary is remitted directly to the families. Allowance for food & housing expenses may sometimes be given.

  • For nurses, 70% of salary is remitted directly to the families while the 30% remains with the worker.

  • Sunday-Thursday workweek is observed.

  • Regular working hours is 8 hours per day (excluding intervals from dining and rest) / 48 hours per week work is also observed.  Additional working hours should not exceed 4 hours per day.

  • For Nurses, regular weekly working hours is 58 hours.

  • Overtime pay for work rendered on:

Ordinary day – 50% of normal wage per hour

Rest day – 200% of normal wage per hour or another rest day

Holidays at 200% of the employees pay rate

  • Annual Vacation Leave is 16 days with full pay for every 1 full year of service rendered.

  • 24 days vacation leave maybe given to  employees who have rendered 5 consecutive years of service or who hold key positions.

  • 15 days for annual sick leave with full payment for every 1 full year of service rendered.

  • The employee whose sickness or disability if proven, shall be entitled to sick leave during which he shall receive 50% of his pay for the first 60 days, to be increased to 60% for the rest days in one year

  • The workers shall receive cash benefit daily for incapacity incurred due to illness or injury

 Just causes for termination of contract

-    misrepresentation

-    termination within the probationary period

-    causing serious damage to employer

-    insubordination or disobedience

-    absence for more than 20 days in a 1 year or more than 10 consecutive days

-    failure to perform basic obligation under the contract

-    disclosure of trade secrets

-    conviction by final judgment of a civil involving moral turpitude, honesty or public morality

-    drunkenness

-    assault of employer or his representative

 Important Reminders

  • Presentation of visa and a valid passport is required upon entry. Seamen are required to present their valid Seaman Book.

  • All persons entering Libya with a visa must register with the immigration offices within 7 days after arrival. (This does not apply to persons holding re-entry permits.)

  • Register with the nearest police within 3 days of arrival to avoid encountering problems during stay or upon departure.

  • Secure an exit permit before leaving Libya.  If you have plans of returning back, apply for a re-entry permit from the Libyan Ministry of Justice before leaving the country.

  • Respect Libyan tradition, customs, practices and strictly observe all their laws and regulations

  • Persons violating Libya's laws, even unknowingly, may be expelled, arrested, or imprisoned.

  • Crime is a growing problem.  Most common crimes are auto thefts, burglaries associated with the increasing availability of drugs. The beaches are the frequent sites of muggings and purse-snatchings.

  • Possession, manufacturing and consumption of liquor is strictly prohibited.

  • Penalties for possession, use, or trafficking of illegal drugs are severe. Convicted offenders will face  jail sentences, heavy fines, and/or flogging or other physical punishments.

  • Due to very strict security, foreigners may at times be place under surveillance by security personnel.

  • Taking photographs of anything that could be perceived as being of military or security interest may result in problems with the authorities.

  • Libya operates on a “cash-only" basis transactions. ATM machines are non-existent.

Transportation System Public transportation is limited to occasional bus service.  There are only two main bus transport companies.

Taxis are available on a shared-basis.  Renting  cars is not recommended.

No railroad in operation.

Libyan Arab Airlines have direct flights to most main cities and towns. Tripoli and Benghazi are served by international airlines.

 

Communication System The postal and telecommunications systems of Libya are government owned and operated.

Telephone landlines and mobile cellular telephone systems, internet service providers, and facilities for domestic and international satellite systems are all available.
